Terms & Conditions

1. The highest bidder shall be the purchaser except where there is a reserve price.

2. No person will be allowed to retract his or her bid after being taken and the vendor reserves the right to bid either by the Auctioneer or the Vendors agent for any lot offered.

3. The Auctioneer shall have the right to refuse any bid from any person, and may decline any bid or offer or withdraw any lots from the sale.

4. The Auctioneer has the right to settle any dispute that may arise and his decision shall be final and binding.

5. No person shall advance a greater or lessor sum than shall be named by the auctioneer.

6. The goods are at the risk of the purchaser from the close of auction (last bid). Neither the Vendor or the Auctioneer shall be accountable for any deficiency, damage or loss which may arise thereafter.

7. Time is of the essence in relation to the sale of any lot.

8. Terms are strictly CASH or BANK CERTIFIED CHEQUE at the agreed time and day of settlement. Any bidder failing to pay within the allotted time or by any other default whatsoever will incur all reasonable solicitors costs in and about the collection of same.

9. Individuals are not permitted to resell or divide lots within the area of the auction.

10. No refunds will be made whatsoever.

11. Members of the public attend the auction at their own risk.

12. No goods are to be removed from the premises until paid for and after close of auction.

13. No person is to remove goods from the premises without proof of purchase, any person found so doing, is guilty of theft, and if a registered bidder, His/Her goods may be confiscated and resold pursuant to any direction by the Auctioneer and their name forwarded to police.

14. All lots displayed have been made available for inspection and must be taken as they are and neither the Vendors nor the Auctioneer will be liable for any misdescription of the goods. The said lots are to be taken with all faults (if any) and no guarantees of any nature whatsoever as to the goods sold are given by the Vendors or Auctioneer.

15. The auctioneer may hold a bid and refer such bid to a vendor before acceptance.

16. In case of non payment, the lot or lots may at the option of the Auctioneer be put up again and resold and the defaulter's bid at the option of the Auctioneer shall not be taken again during the sale.

17. Upon any purchaser failing to comply with any of the above conditions any money deposited in part payment shall be absolutely forfeited and all lots uncleared may be resold by Public Auction or Private Contract and the deficiency (if any) on such resale, together with all costs and charges consequent upon such resale shall be made good by the defaulter at this sale.

18. This auction is a GST Inclusive auction. (eg Vendor pays GST).
